2023 Administrative Consent Order (AC0):
The 2023 Administrative Consent Order (ACO) between the United States Environmental Protection Agency, Region IX (“EPA”), the Department of Navy (“Navy”), and the Defense Logistics Agency (“DLA”) pursuant to Section 7003 of the Resource Conservation and Recovery Act (“RCRA”) and Section 1431 of the Safe Drinking Water Act (“SDWA”) is posted below.
The Consent Order requires Navy and DLA to take steps to ensure the safe and expeditious defueling and closure of the Red Hill Bulk Fuel Storage Facility at Joint Base Pearl Harbor-Hickam (“JBPHH”) in Honolulu, Hawai'i and requires the Navy to perform actions to ensure the delivery of a safe and resilient supply of drinking water for the Navy-owned JBPHH drinking water system.

2015 Administrative Order on Consent (AOC):
The Navy and Defense Logistics Agency (DLA) continue to work collaboratively with federal and state regulatory agencies – the U.S. Environmental Protection Agency and Hawaii Department of Health – under the Administrative Order on Consent (AOC) in a formalized process to continually operate the Red Hill Facility in a manner that ensures the safety of human health and the environment.
The AOC was developed to allow the Navy to address the January 2014 fuel release from Tank #5 as well as xto a create a plan to address any potential future releases of fuel. The AOC includes a Statement of Work (SOW) which is divided into eight sections that addresses overall project management, environmental investigation and remediation as well as tank infrastructure improvements.

May 6, 2021 Fuel Release at Red Hill
A U.S. Navy investigation determined that operator error caused the release of 1,618 gallons of jet fuel (JP-5) from a pipeline inside the Red Hill Bulk Fuel Storage Facility (RHBFSF) on May 6, 2021. The release was not from the fuel tanks. The Navy recovered all but 38 gallons of fuel and has already implemented new procedures, many within days of the incident. The following redacted documents were shared with the regulators, State of Hawaii Department of Health and the Environmental Protection Agency.
